Constitution Pt. 33

July 16, 2010

Amendment X. The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Here it is. The one you’ve been hearing about. The Tenth Amendment. What does this really mean? Is it that hard to figure out? Short version is that the powers not given to the Feds by the Constitution remain with the States or the people. If it doesn’t say the Feds CAN do it, they CAN”T.

Most of the body of the Constitution is laying out what the Federal gubmint can and should do. This Amendment is simply saying that everything else is off limits to them. No wiggle room. No gray areas. They can’t do it. Period. Are you starting to see why what’s going on in DC these days is making people mad?

This is not up for interpretation but if we get enough Kagans on the Supreme Court I’m sure they’ll try. Until next time, screw environmentalists.
